Terms of Service
Important Notice: Please read these Terms of Service carefully before accessing or using HoneyTrack. These Terms constitute a legally binding agreement between you and CrossTech Solutions, governing your access to and use of our mobile applications, web platform, and related services.
1. Introduction & Acceptance of Terms
Contractual Agreement: These Terms of Service ("Terms" or "Agreement") govern your access to and use of the HoneyTrack application ("HoneyTrack", "App", or "Service"), operated by CrossTech Solutions ("Company", "we", "us", or "our"), the legal entity behind the brand Conscious Living.
Binding Consent: By downloading, installing, registering an account, browsing, or using HoneyTrack, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you must not access or use the Service.
2. Eligibility & Account Registration
Age Requirements: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use HoneyTrack independently. Minors aged 13 to 17 may only use the Service under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms.
Account Accuracy: When creating an account via Firebase Authentication (email/password or Google Sign-In), you agree to provide true, accurate, current, and complete registration information, including your display name and handle.
3. Account Security & Credentials
Credential Safeguards: You are solely responsible for maintaining the confidentiality of your login credentials, passwords, and device access tokens.
Unauthorized Access: You accept full responsibility for all activities that occur under your account. You agree to notify us immediately at `care@honeytrackmail.crosstechsolutions.in` if you suspect any unauthorized access or breach of security.
No Liability for Negligence: CrossTech Solutions will not be liable for any loss or damage arising from your failure to protect your login credentials or device security.
4. License Grant & Service Description
Limited License: Subject to your compliance with these Terms, CrossTech Solutions grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable limited license to download, install, and use HoneyTrack for personal, non-commercial habit and wellness tracking.
App Features & Scope: The Service includes access to your Daily Command Center (Hero Tasks & Routine Tasks), Carry-Forward Intelligence, Streak Engine with monthly protected Streak Freezes (6 freezes per month), Mood Sandbox Diary, YTD Activity Grids, AI Reflection Letters, and curated themes.
5. Acceptable Use & Prohibited Conduct
You agree to use HoneyTrack strictly for lawful purposes and in accordance with these Terms. You explicitly agree NOT to:
- System Tampering: Reverse engineer, decompile, disassemble, modify, or attempt to derive the source code or underlying algorithms of HoneyTrack.
- Automated Scraping: Use any robot, spider, scraper, crawler, or automated means to extract data or content from the Service without express written permission.
- Malicious Code: Introduce viruses, Trojan horses, worms, logic bombs, or other malicious software intended to interrupt or damage server infrastructure.
- Unauthorized Access: Attempt to gain unauthorized access to other user accounts, Firebase Firestore databases, or server networks.
- Unlawful Content: Store, upload, or transmit any illegal, abusive, harassing, defamatory, vulgar, or infringing material within your diary or habit notes.
6. Artificial Intelligence (AI) Features & Medical Disclaimer
AI Reflection Letters (Groq API): HoneyTrack offers AI-driven features (powered by Groq API integration) to synthesize unstructured diary entries into empathetic reflection letters. AI processing occurs ephemerally and is not retained or used for third-party AI model training.
CRITICAL MEDICAL & THERAPY DISCLAIMER: HoneyTrack is a personal productivity, routine, and self-reflection tool. THE APP, ITS AI REFLECTION LETTERS, MOOD TRACKING, AND HABIT ANALYTICS DO NOT CONSTITUTE MEDICAL, PSYCHIATRIC, PSYCHOLOGICAL, DIAGNOSTIC, OR CLINICAL THERAPY ADVICE. HoneyTrack is not a medical device or healthcare provider. If you are experiencing mental health crises, distress, or clinical medical conditions, you must consult a qualified healthcare professional immediately.
7. User Content & Data Ownership
Your Data Remains Yours: You retain 100% ownership of all habit checklists, custom templates, personal notes, mood ratings, and diary entries ("User Content") created or submitted by you in HoneyTrack.
License for Service Execution: You grant CrossTech Solutions a worldwide, royalty-free, non-exclusive license solely to host, cache, store, and process your User Content as necessary to deliver app features (e.g., streak calculations, cloud synchronization, AI letter generation).
Data Export & Danger Zone Purging: You maintain the right to export your data or permanently wipe all stored content at any time via the Danger Zone options in app Settings.
8. Intellectual Property Rights
Ownership of Brand Assets: All right, title, and interest in and to HoneyTrack—including software code, visual themes (Sky Blue, Amber Gold, Blush Warm, Mono), mascot designs ("Thinking Blob"), logos, UI components, animations, documentation, and trademarks ("HoneyTrack", "Conscious Living")—are and remain the exclusive property of CrossTech Solutions.
No Implied Rights: Nothing in these Terms grants you any right, title, or interest in CrossTech Solutions' trademarks, trade secrets, or intellectual property except for the limited use license granted herein.
9. Subscriptions, Features & Quota Management
Feature Rules & Streak Freezes: HoneyTrack provides mathematically managed features, including 6 monthly protected Streak Freezes. Protected rest days allow you to preserve your streak without penalty. Unprotected breaks will reset your active streak counter.
Future Paid Services: CrossTech Solutions reserves the right to introduce optional premium features, subscription tiers, or cloud sync upgrades. Any changes to pricing or paid features will be communicated in advance.
10. Service Availability & Modifications
Service Updates: We reserve the right to update, modify, enhance, or temporarily suspend features, APIs, or versions of HoneyTrack for maintenance, security patches, or app improvements.
Offline Availability: HoneyTrack is built with an offline-first architecture. While core features operate locally, features requiring cloud sync or real-time AI reflections depend on active internet connectivity.
11. Disclaimer of Warranties ("AS IS")
"AS IS" & "AS AVAILABLE": HONEYTRACK IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
No Guarantee of Uninterrupted Operation: CROSSTECH SOLUTIONS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES.
12. Limitation of Liability & Indemnification
Cap on Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, IN NO EVENT SHALL CROSSTECH SOLUTIONS, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, REVENUE, PROFIT, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE HONEYTRACK.
Indemnification: You agree to defend, indemnify, and hold harmless CrossTech Solutions and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of your violation of these Terms, misuse of the App, or infringement of any third-party rights.
13. Termination & Account Cancellation
Termination by You: You may terminate these Terms at any time by deleting the App and permanently purging your account via the Danger Zone settings.
Termination by Us: We reserve the right to suspend or terminate your access to HoneyTrack immediately, without prior notice, if you breach any material provision of these Terms or engage in fraudulent or illegal activity.
14. Governing Law, Dispute Resolution & Grievance Mechanism
Governing Law: These Terms shall be governed by and construed in accordance with the laws of **India**, without regard to its conflict of law principles.
Jurisdiction: Any legal suit, action, or proceeding arising out of or related to these Terms or HoneyTrack shall be instituted exclusively in the competent courts located in **Lucknow, Uttar Pradesh, India**.
